Decision

  1. On a finding that the Operator has breached the requirements of the Operator’s Licence pursuant to sections 26(1)(a), 26(1)(b), 26(1)(e), 26(1)(f) and that there has been a material change under section 26(1)(a), Harjinder Singh has lost his repute as a Transport Manager and is disqualified from relying on his Certificate of Professional Competence unless and until he completes the rehabilitation measure outlined below.

  2. As a result the Operator is found to no longer meet the continuing and mandatory requirement for good repute and professional competence under section 27(1)(a) and the operator’s licence must be revoked from 23:45 on 29 June 2021, to allow a safe and orderly wind down.

  3. On a finding that the applicant has failed to satisfy me as to the requirements of section 13A(2)(b), (d), 13C(2) and (4), the application for a substantive operator’s licence is refused and any interim authority must terminate under section 24(6).
