The Traffic Commissioner deciced:

Pursuant to adverse findings under sections 26(1)(b), (e) and (h) and that Manhani Transport Ltd no longer meets the requirements of sections 13A(2)(b) and (d), the licence is revoked with effect from 23:45hrs on 31 December 2020.

Manhani Transport Limited is disqualified from holding or obtaining an Operator’s Licence for a period of 3 years under section 28(1) and its Director, Lakhbir Singh, is made the subject of a similar order for 3 years, pursuant to section 28(4).

Upon a finding that Transport Manager, Lakhbir Singh, no longer satisfies the requirements of Section 13A(3) to be of good repute in accordance with Schedule 3 and a finding that he is unfit to manage the transport activities of an undertaking, Lakhbir Singh is disqualified from relying on his Certificate of Professional Competence for a period of 3 years.

Pursuant to adverse findings under sections 6, 26(1)(b), (e) and (h) and that RSD Transport Ltd no longer meets the requirements of sections 13A(2)(b) and (d), the licence is revoked with effect from 23:45hrs on 31 December 2020.

Having failed to satisfy that the requirements of sections 13A(2)(b), (d), 13C(2) and (4) are met, the application to increase authority is refused under section 17.

RSD Transport Limited is disqualified from holding or obtaining an Operator’s Licence for a period of 4 years under section 28(1) and its Director, Lukwinder Dhami, is made the subject of a similar order for 4 years, pursuant to section 28(4).

Upon a finding that Transport Manager, Gardawar Singh, no longer satisfies the requirements of Section 13A(3) to be of good repute in accordance with Schedule 3 and a finding that he is unfit to manage the transport activities of an undertaking, Gardawar Singh is disqualified from acting as a Transport Manager on any Operator’s Licence unless and until he retakes and obtains a new Certificate of Professional Competence.
