The Deputy Traffic Commissioner for North East England decided:

the licence held by L & P London Services Ltd is revoked under sec. 27(1) of the Act having regard to:

  • no longer of good repute – sec. 13A(2)(b)

  • financial standing not met – sec. 13A(2)(c)

  • no longer professionally competent on a loss of good repute for the nominated transport manager – sec. 13A(3)(a) & Sched. 3.

the licence held by L & P London Services Ltd is revoked under sec. 26(1) of the Act having regard to:

  • failing to fulfill statement of intent, namely, that 6 weekly safety inspections would take place– sec. 26(1)(e).

  • failing to fulfill undertakings on the licence, namely, to keep vehicles fit and serviceable, to observe the rules on drivers’ hours and tachographs and keep proper records, maintain an effective driver defect reporting system – sec. 26(1)(f).

  • material change in the circumstances of the holder, namely, failed to attend New Operator’s Seminar, failed to respond to DVSA Desk Based Assessment – sec. 26(1)(h).

Transport Manager, Laurentiu Iulian Branescu, has lost his good repute as a transport manager and is disqualified indefinitely from acting as a transport manager for any road transport undertaking – Sched.3 para.1 & 16(2).

Transport Manager, Laurentiu Iulian Branescu, shall regain his Certificate of Professional Competence by examination in the UK if he wishes to regain his professional competence and act as a transport manager in the UK in the future – Sched.3 para.17

Revocation of the operators licence and disqualification of the transport manager will come into effect on 15th July 2022 at 00.01.
