The Traffic Commissioner decided:
JCT Travel Ltd (PC1133210)
The operator’s licence for JCT Travel Limited PC1133210 is suspended with effect from 23:45 hours on Friday 18 December 2020 until 23:45 hours on Sunday 3 January 2021.
A formal warning is recorded.
The application to vary the licence to allow the use of 10 vehicles at the operating centre at Minara Yard, Manchester M22 4RB is granted. The operating centre at Sawfield Nurseries, Sale, M33 2JT should be removed from the licence.
The following undertakings offered by the operator shall be recorded on the licence:
- The operator will ensure that all vehicles will be subject to a multi-check inspection immediately before presentation for MoT test. The results will be recorded, and the records will be kept for at least 15 months.
- The operator will arrange for maintenance and drivers’ hours compliance systems, to be audited by an independent third party in February 2021. A copy of the report will be forwarded to the Office of the Traffic Commissioner (OTC) before 15 March 2021 together with the Operator’s proposals for implementing its recommendations. A further audit will be arranged for August 2021 and a copy submitted to the OTC before 15 September 2021 together with the Operator’s proposals for implementing its recommendations. Audit reports will be prepared, acted upon, and retained for at least 2 years.
*The operator will provide financial evidence in the name of the operator covering the full period of 1 January 2021 to 31 March 2021 to the OTC by no later than 30 April 2021. This must show that the operator has continued to meet the required level of available finance throughout the period by reference to an average balance, dependant on the rates applicable at that time.
James William Owen - Transport Manager
I confirm the appointment of James William Owen as Transport Manager;
Mr Owen’s repute is tarnished but not lost;
I record a warning about Mr Owen’s future conduct;
I record a Statement of Intent from Mr Owen that he will not seek appointment as a transport manager on any licence other than JCT Travel Ltd PC1133210 and Keith Whittam trading as Rixton Travel PC2002570 without the prior approval of the Traffic Commissioner. Mr Owen will withdraw his nomination as transport manager for Bestway Minibuses Limited PC1120654 by 8 January 2021.
