Decisions made in respect of operator’s licence held by G&N Transport Ltd OG1146309

  1. Adverse findings are made under section 26(1)(f) of the 1995 Act.

  2. The operator is issued a warning in relation to future compliance.

  3. The operator agrees to the following undertakings being attached to the licence:

i) The operator will arrange an independent audit to be carried out by RHA, Logistics UK, or other suitable independent body, by 31 August 2021. The audit will assess the systems for complying with maintenance and drivers’ hours requirements and the effectiveness with which those systems are implemented. A copy of the audit report, together with the operator’s detailed proposals for implementing the report’s recommendations, must be sent to the Office of the Traffic Commissioner in Caernarfon within 14 days of the operator receiving the audit report.

ii) The operator will employ all its regular drivers, and discontinue using “self employed” drivers, other than on an ad hoc basis.

  1. The application received on 18 September 2020 to vary the licence to authorise 20 vehicles and 20 trailers is granted on interim basis, but for 17 vehicles and 17 trailers, not the 20 sought.

  1. Craig Russell McCarthy is unfit to hold a vocational licence. His vocational driving licence is revoked from 0001 hours on 12 June 2021 and he is disqualified from holding or applying for any vocational licence until 12 March 2022.
