Mr Dewy is prevented from relying on his Certificate of Professional Competence. Mr Dewey can apply to a Traffic Commissioner to vary that direction under paragraph 17 of Schedule 3 of the Act, at which time the presiding Commissioner will need to be satisfied as to his ability to meet the statutory duty.
