Decision - Goods Vehicle (Licensing of Operators) Act 1995
Pursuant to adverse findings under sections 26(1)(c)(iii), (e) (f) and (h), the good repute of the operator is severely tarnished, and the operator’s licence is curtailed by 1 vehicle for 3 months. The operator has 7 days from the date of this decision to return the relevant disc. I make an order under section 26(6) preventing its use on another operation during that period.
Upon a finding that Transport Manager, Cosmin Mihai Ion Mircea, no longer satisfies the requirements of Section 13A(3) to be of good repute in accordance with Schedule 3 and a finding that he is unfit to manage the transport activities of an undertaking, Cosmin Mircea is disqualified from relying on his Certificate of Professional Competence unless and until he has worked with an experienced and sufficiently robust CPC holder, who is capable of managing the traction of third-party trailers, for a period of 12 months and a Traffic Commissioner is satisfied that he can assume the responsibilities of a Transport Manager.
Pursuant to the above, the operator no longer meets the requirement for professional competence under section 27(1)(a) and is granted a Period of Grace for a period of two months, for the purposes set out below.
Having failed to satisfy me as to the requirements of section 17 and specifically sections 13A(2)(d) and 13C(4), the application to vary this licence and increase authority, is refused.
