The Traffic Commissioner for Wales decided:

Decisions made in respect of 24/7 Elaine’s Minitravel Ltd PG2008505

Pursuant to adverse findings under sections 17(3)(a), (aa) and (c) of the Act, operator licence PG2008505 is suspended for a period of 28 days with effect from 23:45 hours on 14 August 2022.

The operator’s repute is severely tarnished, but not lost.

The following undertaking, agreed to by the operator, is attached to the licence:

  • The operator shall arrange for an independent audit to be carried out by the RHA, Logistics UK or other suitable body, by 28 February 2023. The audit will assess the systems for complying with drivers’ hours and working time directive requirements and the effectiveness with which those systems are implemented. The audit shall specifically cover the systems in place for recording use of vehicles authorised on the licence and systems for recording all work, whether within scope of EU drivers’ hours rules or not (e.g rail replacement and school contract work). A copy of the audit report together with the operator’s detailed proposals for implementing the report’s recommendations must be sent to the Office of the Traffic Commissioner in Caernarfon by 16 March 2023. It is for the operator to comply with this undertaking and no reminders will be sent.

Application to vary the operator licence by removing the named operating centre at Unit 14, St David’s Industrial Estate, St David’s Road, Swansea Enterprise Park, Swansea SA6 8RX and adding a new operating centre for 2 authorised vehicles at Part Yard, Westfield Industrial Park, Waunarlwydd, Swansea, SA5 4SF, is granted.

An adverse finding having already been made under section 17(1)(a) of the Act that the operator no longer meets the requirement of section 14ZA(2) as to professional competence, the period of grace already in place to allow a new transport manager to be nominated and approved is further extended to 6 September 2022.

Pursuant to adverse findings under sections 17(3)(aa), (d) and (e) of the Act, operator licence PG1068365 is revoked with effect from 23:45 hours on 5 August 2022.
