Details

This memorandum addresses issues arising under the European Convention on Human Rights (“ECHR”) in relation to the Data Retention and Investigatory Powers Act. The Department is satisfied that, in the event that the Bill is introduced into parliament, the responsible minister could make a statement under section 19(1)(a) of the Human Rights Act 1998 that, in his or her view, the provisions of the Bill are compatible with the Convention rights.
