Notice by the Secretary of State under section 52 of the National Parks and Access to the Countryside Act 1949: Iwade to Grain, lengths IGR4 and IGR6

Introduction

On 15 January 2020 Natural England submitted a compendium of coastal access reports relating to the stretch of coast between Iwade to Grain to the Secretary of State for Environment, Food and Rural Affairs under section 51 of the National Parks and Access to the Countryside Act 1949 (“the 1949 Act”), pursuant to its duty under section 296(1) of the Marine and Coastal Access Act 2009 (“the 2009 Act”). 

This determination only relates to lengths IGR4 and IGR6. The proposals for lengths IGR1, IGR2, IG3, IGR5, IGR7, IGR9 and IGR10 were approved on 18th August 2020 and the proposal for length IGR8 was approved on 12th November 2020.

In reaching a determination under section 52 of the 1949 Act the Secretary of State has considered:

a. Iwade to Grain length reports IGR4 and IGR6 – part of Natural England’s coastal access report compendium for Iwade to Grain submitted to the Secretary of State on 15 January 2020

b. in accordance with paragraph 16(1)(a) of the Schedule, the objections which the appointed person determined to be an admissible objection

c. in accordance with paragraph 16(1)(b) of the Schedule, Natural England’s comments on the admissible objections which it sent to the Secretary of State

d. in accordance with paragraph 16(1)(c) of the Schedule, the reports given to the Secretary of State by the appointed person in respect of the objections which the appointed person determined to be an admissible objection

e. in accordance with paragraph 16(1)(d) of the Schedule, representations made by a person within paragraph 2(2)(b) to (f) of the Schedule and the summary of other representations made, and Natural England’s comments on those representations which it sent to the Secretary of State in March 2020

In this notice –

(a)  “objection” means an objection about the coastal access report which is made under paragraph 3 of Schedule 20 of the Marine and Coastal Access Act 2009; and

(b) “representation” means a representation about the coastal access report which is made under paragraph 7 of Schedule 20 of the Marine and Coastal Access Act 2009.

Secretary of State’s approval of coastal access proposals

The Secretary of State has determined to approve those proposals for the route and associated coastal margin as set out in length reports IGR4 and IGR6.

In the respects specified in the objection set out at Annex A to this notice, the Secretary of State determines that the proposals set out in the coastal access report do not fail to strike a “fair balance” as a result of the matters specified in the objections. The Secretary of State therefore approves the proposals set out in the coastal access report so far as they relate to those parts of the route (and associated coastal margin) to which the objection relates.   

Where proposals are approved in full, the additional conclusions and observations of the Secretary of State in relation to the representations are set out at Annex B to this notice.

The land in the Report to which the objection relates are route sections IGR-4-S005 to IGR-4-S016. The Secretary of State notes the consideration and recommendation of the appointed person in regard to this objection and agrees with the inspector’s conclusion that the proposed sections of the King Charles III England Coast Path are unlikely to cause significant negative impacts concerning the issues raised around security, privacy, financial impact, and the environmental or operational consequences, including concerns about public access near private properties, potential disruption to business operations, and risks to local habitats. These concerns can be mitigated with appropriate waymarking, signage, and other measures as suggested by Natural England. Consequently, the Secretary of State approves the proposals in relation to this route section.

The land in the Report to which the objection relates are route sections IGR-4-S019 to IGR-4-S020 and IGR-4-S0524.The Secretary of State notes the consideration and recommendation of the appointed person in regard to this objection and agrees with the inspector’s conclusion that the proposed sections of the King Charles III England Coast Path are unlikely to significantly harm the living conditions of landowners or residents, nor increase anti-social or illegal activities as suggested by the objector. While alternative routes, including the Saxon Shore Way along Church Path, were considered, none were deemed to meet the coastal access objectives. The proposed trail would maintain coastal views and is not expected to negatively impact visitors to St Margaret’s Church or local tourism and economic activity. Consequently, the Secretary of State approves the proposals in relation to this route section.

The land in the Report to which the objection relates are route section IGR-6-S010 to IGR-6-S013. The Secretary of State notes the consideration and recommendation of the appointed person in regard to this this objection and agrees with the inspector’s conclusion that Natural England’s proposed amendment, which excludes year round access on the seawall and coastal grazing marshes around Upchurch Peninsula, is necessary to protect bird populations and address the concerns raised. Consequently, the Secretary of State approves the proposals with the amendment in relation to this route section.

Consequently, the Secretary of State approves the proposals with the amendment in relation to this route section.

The land in the Report to which the objection relates are route sections IGR-6-S015 to IGR-6-S018, including IGR-6-A001. The Secretary of State notes the consideration and recommendation of the appointed person regarding the objection raised and agrees with the inspector’s conclusion that the proposed sections of the King Charles III England Coast Path are unlikely to significantly harm living conditions, shooting activities, public safety, or liability issues. The land in question is not classified as garden or exempted land and various potential alternatives were thoroughly assessed with no more suitable options identified. Consequently, the Secretary of State approves the proposals in relation to this route section.

The Secretary of State acknowledges the Ramblers’ preference for the sea wall route around Barksore Marshes. However, the Secretary of State concurs with Natural England’s proposed route, which carefully considered potential wildlife impacts and prioritised avoiding disturbances to sensitive bird populations while aiming to provide a scenic and accessible route where feasible.

Secretary of State’s conclusion and observation:
The Secretary of State notes Historic England’s concerns about potential impacts on scheduled monuments, listed structures, and conservation areas along the route. The Secretary of State acknowledges Natural England’s confirmation that Report IGR 4 does not include any designated scheduled monuments. With respect to the Lower Halstow Conservation Area, the Secretary of State supports Natural England’s approach, which involves working with local authorities to ensure that the design and placement of signs are appropriate and do not negatively impact the conservation area’s historic and environmental values.

However in order to mitigate the adverse effect to the landowners on this section, it is suggested that an amendment would be needed between IGR-4-S001 and IGR-4-S010.

The Secretary of State acknowledges the National Farmers Union’s concerns regarding potential impacts on Great Barksore Farm, including disruptions to countryside stewardship agreements, limitations on farming flexibility, and security risks. However, the Secretary of State concurs with Natural England’s assessment that the trail alignment has been carefully designed to minimise disruption by positioning the path along grass margins to reduce impact on farm operations, ensuring compatibility with stewardship requirements, and maintaining a sufficient distance from farm buildings to mitigate security concerns.

Secretary of State’s conclusion and observation:
The Secretary of State acknowledges the Country Land and Business Association’s concerns about the impact of the proposed trail on shooting activities and potential harm to farming businesses, potential harm to farming businesses due to its proximity to arable land, as well as their suggestion to use existing routes like the Saxon Shore Way and Sheerness Road. However, the Secretary of State concurs with Natural England’s response that temporary diversions can minimise disruption to shooting activities, the trail’s alignment along grass margins reduces impact on arable land, and the use of the Saxon Shore Way and Sheerness Road was deemed unsafe by Kent County Council.

Secretary of State’s conclusion and observation:
The Secretary of State acknowledges the concerns regarding the proposed trail’s alignment, safety, and convenience. However, the Secretary of State supports Natural England’s assessment that the trail avoids sensitive wildlife areas and notes that they will work with Kent County Council to address any safety issues. Additionally, the Secretary of State agrees with Natural England’s decision to reject the use of the Saxon Shore Way and Sheerness Road, as these routes were deemed unsafe by Kent County Council.

The Secretary of State notes the concerns raised regarding the route’s deviation from the Saxon Shore Way, including suggestions that it limits coastal views and crosses private property without sufficient protection measures, as well as potential risks to wildlife habitats and accessibility issues. However, the Secretary of State supports Natural England’s position that the proposed route effectively protects sensitive areas, maintains adequate views of the coast, and strikes a balance between public access and conservation efforts. Also, clear signage and path management will mitigate concerns related to security and access.

The Secretary of State notes Historic England’s support for the proposals and their advice that Scheduled Monument Consent (SMC) may be required for any new installations or ground disturbances within scheduled areas. However, the Secretary of State supports Natural England’s position that the proposed route falls outside areas of Scheduled Monument designation, thus allowing for minor path improvements without the needing to obtain SMC.

This alignment was developed in collaboration with the landowner and will provide a clear, well-signposted path, reducing the likelihood of walkers straying from the road.

The Secretary of State notes the residents’ concerns regarding the potential use of the car parks at Beckenham Mobile Home Park by visitors of the KCIIIECP. However, the Secretary of State supports Natural England’s assessment that these car parks are designated for residents and their visitors, and that the proposed trail alignment will not adversely affect their use. Natural England is also willing to include information about parking restrictions on new signage, should the landowner request it.

However, the Secretary of State supports Natural England’s position and measures, including a dog-on-lead policy along the proposed path and new signs to inform visitors of this policy at both ends of the site. The Secretary of State also notes Natural England has collaborated with Swale Borough Council to explore options for installing new dog waste bins once the proposals are approved.

The Secretary of State notes the concerns that the trail was not aligned closer to the coast along the seawall, particularly north of Ham Green. However, the Secretary of State supports Natural England’s position that this alignment was not feasible due to potential disturbances to critical bird populations and safety concerns regarding the Saxon Shore Way at Horsham Lane.
