Circular 010/2015: changes to the management of limited duties: Police (Amendment) Regulations 2015 (SI 2015/455) and supporting determinations

This circular draws attention to the contents of the Police (Amendment) Regulations 2015 (SI 2015/455) which will come into force on 1 April 2015. The circular also publishes related amendments to the Secretary of State’s determinations made under Police Regulations 2003 (as amended), which will come into effect on 1 May 2015.

These changes implement reforms of “restricted duties” as set out in Home Office Circular 002/2014.

The Police (Amendment Regulations) 2015 – 1 April 2015

SI 2015/455 amends Regulation 22 and inserts a new regulation 28A into the 2003 Regulations, which will, with effect from 1 April 2015:

  • allow the Secretary of State to determine the circumstances in which a member of a police force may be placed on limited duties
  • define limited duties as recuperative duties, adjusted duties and management restricted duties
  • allow the Secretary of State to determine the entitlement to pay of a member placed on adjusted duties.

0.1 Amendments to determinations at Annex EE – 1 May 2015

Following the Police (Amendment) Regulations 2015 coming into effect, the Secretary of State has agreed to amend determinations under Police Regulations 2003, with effect from 1 May 2015, to set out:

  • the circumstances in which a member of a police force may be placed on limited duties, including detailed definitions of the three categories of limited duties: (recuperative duties; adjusted duties and management restricted duties)

  • the circumstances in which an element of pay may be deducted during periods when that member is carrying out adjusted duties

The relevant amendments inserting Annex EE in determinations under Police Regulations 22 and 28A are attached to this circular.

0.2 Guidance

This circular should be read in conjunction with current national guidance developed with the Police Advisory Board and other policing partners.

The guidance will be owned by the National Policing Lead for Reward and Recognition who will issue it directly to forces.

As at the date of publication, the interim version of this guidance is attached to this circular although it may be removed and replaced with a link in this section once published on an external policing website. It should be noted that since the Home Office does not own this document, any queries about it should be addressed to force HR leads in the first instance.

0.3 Review

Given the complexity of these changes, a review date of September 2016 has been set for these determinations in order to monitor the impact in forces once any pay adjustments start to be made.
