Details

The Charities (Protection and Social Investment) Act 2016 had four main policy objectives:

  1. provide new and strengthened powers for the Charity Commission for England and Wales
  2. extend the criteria for automatic disqualification from charity trusteeship and apply disqualification to senior management positions
  3. strengthen the transparency and accountability of charity fundraising
  4. give charity trustees an explicit legal power to make social investments

Section 16 of The Charities Act 2016 states that the Secretary of State must carry out reviews of the operation of the Act. This Post-Implementation Review is the first review of The Charities Act 2016 and aims to determine whether the policy objectives, as set out by the Impact Assessment and Regulatory Triage Assessment, have been met. It also aims to answer the questions posed in the Charities Act 2016 in regards to public confidence in charities, levels of charitable donations, and willingness to volunteer.
