Chapter 08 – appendix FM family members: caseworker guidance

  1. Three documents updated in line with Immigration Rules changes: (i) Family migration: Appendix FM and adult dependent relatives - adequate maintenance and accommodation (ii) Family Policy: Adult dependent relatives (iii) Family Migration: Appendix FM and Appendix HM Armed Forces - Minimum income requirement.

  2. Updated guidance on adult dependent relatives published.

  3. Updated appendix FM and Adult Dependent Relative - adequate maintenance and accommodation to add information on benefits payable by Social Security Scotland which provide an exemption from the Minimum Income Requirement on a relevant route to settlement.

  4. Appendix FM and Appendix HM Armed Forces: minimum income requirement updated with the following: addition of benefits payable by Social Security Scotland which provide an exemption from the Minimum Income Requirement (MIR) on a relevant route to settlement; clarified when maintenance payments from former partners can be used towards meeting the MIR.

  5. Updated Appendix FM and Appendix HM Armed Forces: minimum income requirement to change currencies where FDCO CER should be used.

  6. Appendix FM 1.7: financial requirement updated to reflect the increase to the minimum income requirement laid in the Statement of Changes to the Immigration Rules (HC 590 laid in parliament on 15 march) which comes into force on 11 April 2024, including transitional arrangement. A full list of changes is available in the guidance. The name of this guidance has been changed to "Appendix FM and Appendix HM armed forces: minimum income requirement".

  7. Updated 'Appendix FM 1.7: financial requirement' to remove the requirement for a current appointment report from Companies House.

  8. Guidance on adult dependant relatives updated to correct an error relating to partners and provide clarification on when the financial undertaking must be made.

  9. Guidance on Appendix FM 1.7a updated and renamed 'Appendix FM and adult dependent relatives: maintenance and accommodation'. COVID-19 concession section also updated. Guidance on adult dependent relatives updated to refer to provisions of new Appendix ADR to the Immigration Rules and to change reference from Refugee Leave and Humanitarian Protection Leave to Protection Status.

  10. Added accessible versions of each document. Deleted annex FM 3.2a, which was a duplicate of annex FM 3.2.

  11. 'Adult dependent relatives' guidance updated to remove references to CID.

  12. Updated appendix FM 1.7: financial requirement and appendix FM 1.7a: maintenance guidance.

  13. Updated 'Adult dependent relatives' guidance.

  14. Replaced Appendix FM 1.7a: maintenance document with a new version.

  15. Appendix FM section 1.7 published with updated information on COVID-19 concessions.

  28. Replaced 'Appendix FM 1.0a: Family Life (as a Partner or Parent): 5-year routes and exceptional circumstances for 10-year routes' with a new version.

  31. Updated contact details in Appendix FM 1.7 Financial Requirement

  32. Updated "Appendix FM 1.0a: Family Life (as a Partner or Parent): 5-Year Routes" to reflect rules changes, minor corrections and alterations since August 2015. Changes have been made following various judgments.
