Details

Mr Fellica made a complaint under section 108A (1) of the Trade Union and Labour Relations (Consolidation) Act 1992 that the union breached several of its rules relating to removal from office, disciplinary proceedings by the union and the constitution or proceedings of a decision-making meeting.

The Certification Officer struck out the complaints under section 256ZA of the Trade Union and Labour Relations (Consolidation) Act 1992 on the basis that they had no reasonable prospect of success.

Please note that on 17 October 2025 this decision was revised to amend references to the preferred title and pronouns of the Applicant. For the avoidance of any doubt, this revised version does not change the reasoning nor outcome of the complaint. In any event, for completeness, the original version is appended to the attached decision to show that no changes other than title and pronouns have been made and/or to aid any interpretation where grammatical structure may be affected.
