Details
The Applicants made two complaints of breaches of union rules relating to the 2026 branch elections. The application was made under section 108A(1) of the the Trade Union and Labour Relations (Consolidation) Act 1992.
Following a Case Management Meeting (CMM) which took by Video Conference, on 6 October 2026, the Certification Officer:
-
Dismissed complaint 1 for want of jurisdiction; but was in any event, withdrawn at the CMM by both Applicants.
-
Dismissed Mr Whitehouse’s complaint in complaint 2.
-
Upheld Mr Dabrowski’s complaint in complaint 2 but did not consider it appropriate to make an enforcement order as the union had taken remedial action by the issuance of a best practice guidance and re-ran the election.
