Details

If you’re the testator

Use this form to withdraw your will or codicil from storage from HMCTS.

You’ll need the original certificate of deposit and safe custody reference number.

If you cannot find your certificate, write a letter explaining this.

If you’re an executor or someone else applying for probate

Use this form to apply to withdraw the will or codicil from storage of the testator who’s died and made the will so you can use the original to apply for probate.

You’ll need to provide an official copy of their death certificate with your application.

To apply to withdraw your will or codicil:

  1. download the form
  2. fill in either:
    • section A if you are the testator who wants to withdraw your own will or an update to it or
    • section B if you are either an executor or administrator who wants to withdraw the will after the death of the testator
  3. print the form
  4. sign and date the application with wet ink - HMCTS cannot accept electronic signatures
  5. send the application with the official copy of the death certificate
  6. send your completed form to:
