Local authorities social services grant determination 2022: no 31/6468

The Minister of State for Care and Mental Health (the Minister of State), in exercise of the powers conferred by section 31 of the Local Government Act 2003, makes the following determination:

Citation

1. This determination may be cited as the Local Authorities Social Services Determination 2022 No 31/6468.

Purpose of the grant

2. The purpose of these grants is to provide support to local authorities in England towards expenditure lawfully incurred or to be incurred by them in funding adult social care. These grants cover Local Reform and Community Voices, War Pensions Disregards, Social Care in Prisons (which are routine annual payments) and Client-Level Data Flows Support.

3. The Local Reform and Community Voices grant is worth £34.41 million, and comprises 3 strands:

  • a non-ringfenced contribution towards local authorities to meet their statutory duty to provide a local Healthwatch (£14.15 million)
  • funding for local authorities to meet their statutory duty to provide an advocacy service that helps eligible users to understand and communicate their care needs (£15.11 million)
  • funding for local authorities to assess and implement deprivation of liberty safeguards (DoLS) arrangements in hospitals (£5.15 million)

4. The War Pensions Disregards grant provides funding that allows local authorities to disregard, for the purposes of social care charging, all payments made under the War Pension Scheme with the exception of Constant Attendance Allowance. This grant is worth £12 million and is paid to the Department of Health and Social Care by the Ministry of Defence.

5. The Social Care in Prisons grant covers the cost to local authorities of providing social care in prisons, for which local authorities hold statutory responsibility. This grant is worth £10.95 million.

6. The Client-Level Data (CLD) Flows Support grant is a non-repeating grant that is being made available to support local authorities with the new burden of setting up CLD flows. CLD will become mandatory from April 2023, with the first quarterly return due in July 2023. CLD will be the main source of data on adult social care activity, in future replacing the existing annual Short and Long Term (SALT) collection. This grant is worth £3 million.

Determination

7. The Minister of State determines as the authorities to which the grant is to be paid and the amount of grant to be paid. These authorities and amounts are set out in ‘Grant allocations 2022 to 2023’.

8. Before making this determination in relation to local authorities in England, the Minister of State obtained the consent of the Treasury.

The grant recipient shall do all of the following at all times during and following the end of the funding period:

  • comply with requirements of the HM Government of the United Kingdom of Great Britain and Northern Ireland ‘Funded by UK Government’ branding manual in relation to the funded activities
  • cease use of the ‘Funded by UK government’ logo on demand if directed to do so by the authority
