Introduction of Respect Orders, Youth and Housing Injunctions
Legal aid changed to cover Respect Orders, Youth Injunctions and Housing Injunctions.
Anti-social behaviour injunctions under Part 1 of the Antisocial Behaviour Crime and Policy Act 2014 have now been replaced by:
- Respect Orders
- youth injunctions
- housing injunctions
Respect Orders strengthen the existing anti-social behaviour injunction regime and introduce additional powers, including making breach of an order a criminal offence. Youth injunctions and housing injunctions continue to deal with anti-social behaviour involving children and housing-related cases.
We have updated relevant guidance to confirm that as with Part 1 Injunctions:
- civil legal aid will be available for the making of respect orders, youth injunctions and housing injunctions, and;
- criminal legal aid will be available for breaches of them.
Civil legal aid
Providers should use the existing codes for Part 1 Injunctions for civil legal aid for respect orders, housing injunctions, and youth injunctions.
For legal help, this would be:
- The matter type 1 code XASB and fee code MISCASBI for cases funded as miscellaneous work under the civil contract
- The stage reached code ASAS and fee code ASAS for work being claimed as associated civil work under the crime contract
For legal representation, this would be:
- Proceeding codes NU027/NU028 for civil providers
- Proceeding code CR034/CR035 for crime providers carrying out this work as associated civil work
The intention is that civil legal aid for respect orders, youth injunctions and housing will be remunerated on the same basis as Part 1 Injunctions:
- For legal help, this will be a fixed fee of £157
- For legal representation, this will be the rates at Table 10(a) of Schedule 1 to the Civil Legal Aid (Remuneration) Regulations 2013
These rates will apply to housing injunctions and youth injunctions automatically. However, changes have not yet been made to apply the rates to Respect Order.
Subject to parliamentary approval, it is intended that legislation to remunerate respect orders at these rates will come into force on 17 December 2026.
The new rates will apply to all respect orders commenced following their implementation on 26 October 2026.
You should make sure that any claims or bills for Respect Orders are submitted after 17 December 2026 using the above codes. This will ensure that you are paid the correct fee for this work.
Criminal legal aid
Providers should continue to use the relevant PROV fee code for breaches of youth injunctions, housing injunctions and Part 1 injunctions made before 26 October 2026.
For Respect Orders, providers should use the relevant undesignated area/designated area standard fee code instead of a PROV fee code. This is because a breach of a Respect Order is a criminal offence. Breach claims can be submitted from 26 October 2026.
Providers should read our updated guidance on how to claim for legal aid for Respect Order, Housing and Youth Injunctions in Submit a Bulk Claim and CCMS and make sure they are claiming for this work under the above rules.
