Updates to practice guide 19 will take effect from April 2020.

From 1 April 2020, the recent update to practice guide 19 section 3.1.1 will take effect. This states:

A consent must state it is given to registration of the disposition, rather than simply consenting to the disposition itself.

When requesting consent from the party named in the restriction, customers will need to make it clear that they require consent to registration. And third parties giving consent must state they give consent to registration.

Restrictions in the register make it clear when the powers of the proprietor are limited, or a prior condition must be met before a disposition can be registered. Consenting to registration, rather than the disposition itself, will ensure the requirements of the Land Registration Act 2002 are met.

We understand that customers get consents to registration from third parties, and so we are giving customers 12 months’ notice to embed this practice. From April 2020, applications with incorrectly worded consents will receive an application enquiry (requisition). We have updated practice guide 19 to clarify our requirements.

O 1 Ebrill 2020, bydd y diweddariad diweddar i gyfarwyddyd ymarfer 19 adran 3.1.1 yn dod i rym. Mae hyn yn nodi:

“Rhaid i gydsyniad nodi ei fod yn cael ei roi i gofrestru’r gwarediad, yn hytrach na chydsynio i’r gwarediad ei hunan yn unig”.

Wrth ofyn am gydsyniad y parti a enwir yn y cyfyngiad, bydd angen i gwsmeriaid ei gwneud yn glir bod angen caniatâd arnynt i gofrestru. A rhaid i drydydd partïon sy’n rhoi caniatâd nodi eu bod yn rhoi caniatâd i gofrestru.

Mae cyfyngiadau yn y gofrestr yn ei gwneud yn glir pryd mae pwerau’r perchennog yn gyfyngedig, neu mae’n rhaid bodloni amod blaenorol cyn y gellir cofrestru gwarediad. Bydd cydsynio i gofrestru, yn hytrach na’r gwarediad ei hunan, yn sicrhau bod gofynion Deddf Cofrestru Tir 2002 yn cael eu bodloni.

Rydym yn deall bod cwsmeriaid yn cael cydsyniadau i gofrestru gan drydydd partïon, ac felly rydym yn rhoi 12 mis o rybudd i gwsmeriaid i ymgorffori’r arfer hwn. O Ebrill 2020, bydd ceisiadau â chydsyniadau wedi eu geirio’n anghywir yn cael ymholiad cais (ymholiad). Rydym wedi diweddaru cyfarwyddyd ymarfer 19 i egluro ein gofynion.
