This call for evidence informed the post-implementation review of the Competition Appeal Tribunal Rules 2015.

BEIS carried out an analysis of the responses and published its recommendation in the Post Implementation Review (PIR) and government response.

We received feedback from 3 respondents in the Competition Appeal Tribunal (CAT) user group, and the CMA. See the full responses for in depth feedback on the CAT Rules 2015.

Call for evidence description

The Competition Appeal Tribunal Rules 2015 Statutory Instrument 2015/1648 (the CAT Rules 2015) revoked and replaced the CAT Rules 2003 (SI 2003/1372).

The objectives of the new rules are:

to minimise unnecessary costs and delays while balancing proper accountability for decisions
to ensure effective case management
to provide a framework for the CAT’s extended jurisdiction in private actions related to infringements of competition law, as set out in the Consumer Rights Act 2015

Under the CAT Rules 2015, the Secretary of State is required to carry out a review of the CAT Rules 2015 by 1 October 2020.

This call for evidence will inform the post-implementation review of the CAT Rules 2015 and the information provided in response will help us assess:

the extent to which these objectives have been fulfilled
if these objectives remain appropriate
if these objectives could be achieved by a system that imposes less regulation

The Review covers the period from 1 October 2015 to 30 September 2020.
