Consultation description

The law has not changed and the duty to provide home to school transport remains with local authorities. However, the current guidance was published in 2007 and needs to be updated to reflect better the schools system that has developed since 2010.

The new guidance aims to reduce prescription and allow greater freedoms for local authorities to develop transport policies that meet the needs of their areas.

The guidance also sets out a recommended appeals process that is intended to be both clearer, for parents and local authorities, and more independent.
