Judicial Summary

The First-tier Tribunal’s decision to dismiss an appeal against a decision refusing to make an EHC Plan erred in law by overlooking a material consideration and by failing to address anticipated needs and because the absence from the bundle of a key document resulted in an unfair hearing. The decision is remade so as to require an EHC Plan to be made.
