Judicial Summary

When the FTT lacks information that it needs to decide an application for postponement, it should normally ask for that information. The test under r.31(b) of the SEC Procedure Rules is whether it is in the interest of justice for to proceed with a hearing in the absence of a party, not whether there is sufficient evidence to enable it to do so.
