Judicial Summary
This was an appeal against a decision of the Presiding Officer dated 6 January 2025 revoking the operator’s licence, disqualifying the Appellants from holding or obtaining an operator’s licence for three years, and disqualifying Mr Coyle from acting as a transport manager for three years. The Upper Tribunal dismissed the appeal, finding that the Presiding Officer’s decision was not “plainly wrong”. The Tribunal, having refused to admit fresh evidence, upheld the findings that the operator had lost its good repute and that revocation, together with the associated disqualifications, was a proportionate and lawful regulatory response.
