Discretionary trusts: Income Tax and CGT on the trust

While it is ongoing, income and capital gains generated by the trust assets are subject to Income Tax and CGT. This aspect of taxation is dealt with by

  • HMRC Trusts, and
  • CNR (for foreign trusts or where trustees are overseas)

There will be occasions when you need to liaise with these offices. (IHTM42641)

You can find details of the taxing regimes at the Trusts Manual, from TSEM3000.
