IHTM28001 - Liabilities: summary

This section of guidance tells you about the deduction of debts and liabilities from the deceased’s estate. Information about liabilities that may be deducted from lifetime transfers (IHTM14013) and settled property (IHTM16094) can be found in the sections of the manual that look at these particular subjects in more detail.

This section provides guidance on how both legislation and general law apply to debts in the deceased’s estate and gives advice on how to investigate specific types of liabilities. Special attention is given to investigating those debts that appear on supplementary page IHT419 that may be submitted with the form IHT400. These include the anti-avoidance rules contained in FA86/S103.
