Compliance: borrowers compliance: contentious appeals

There is no information gateway with the Department for Innovation Universities & Skills (DIUS) (This content has been withheld because of exemptions in the Freedom of Information Act 2000) . Consequently, if evidence is required in a contentious appeal concerning whether a borrower was switched on but had not been switched off, or if a borrower otherwise challenges that he is liable to make Student Loan repayments, evidence can only be supplied by the Student Loans Company, or Secretary of State as appropriate, as a witness at the appeal hearing.

In most cases the liability to make repayments will not be in dispute, and

  • You should be able to include this in an agreed statement of facts

Or

  • The required evidence, such as a copy of the switch on letter, can be obtained from the borrower using the regulation Schedule 36 information power
