Incineration of any substance or object

This guidance outlines the circumstances under which a marine licence may be required from the MMO.

Applies to England and Northern Ireland

Overview

A marine licence is required to incinerate any substance or object within English Waters and Northern Ireland offshore waters. This applies if the incineration will take place on a:

  • Vehicle
  • Vessel
  • Marine structure
  • Floating container

‘Vehicle’, ‘vessel’, ‘marine structure’ and ‘floating container’ are defined in Section 115 of the MCAA 2009.

Incineration anywhere else in the world

A marine licence is required to incinerate any substance or object anywhere else at sea outside English waters and Northern Ireland offshore waters if the incineration will take place on a:

  • British vessel
  • British marine structure
  • Floating container (if the incineration is controlled by either of the above or a British aircraft)

‘British vessel’, ‘British marine structure’ and ‘floating container’ are defined in Section 115 of the MCAA 2009.

A marine licence is also required to load a substance or object for incineration anywhere else at sea when that loading takes place in any part of the UK (except Scotland) or in English waters or Northern Irish offshore waters.

This applies when the substance or object for incineration is loaded onto any:

  • Vehicle
  • Vessel
  • Aircraft
  • Marine structure
  • Floating container
