The Equality Act 2010 lists 9 Protected Characteristics:

  • Age
  • Sex
  • Race
  • Disability
  • Sexual Orientation
  • Religion or Belief
  • Gender Reassignment
  • Marriage/Civil Partnership
  • Pregnancy/Maternity

This report focuses on those protected characteristics where data are collected, and are of sufficient quality for statistics to be meaningful. In general, this report is limited to analysis on sex, age, race (ethnicity) and religious belief for these reasons. Where data are available for other protected characteristics at sufficient quality and with sufficient coverage to be meaningful, they are also presented and considered.

The report presents some analysis by individual characteristic and is meant to serve as a guide for further research. In many cases, more than one factor (e.g. age and another protected characteristic, criminal history, socio-economic) may have an effect on an outcome.

The HMPPS Offender Equalities Report is produced and handled by the Ministry of Justice’s (MOJ) analytical professionals and production staff. Pre-release access of up to 24 hours is granted to the following persons:

  1. Some cells within Table 1.2 have been reformatted to ensure consistency throughout the data file. No data values have changed during this revision.

  2. The line showing the proportion of all prisoners who had Standard Incentives status on Figure 4.1 was found to be inaccurate due to a formatting error and has been corrected. The labels for sub-categories under Ethnicity, Religion, and Sexuality protected characteristics on Figure 4.2 were found to be misaligned to the data due to a transposition error. This has now been updated. Additionally, the figure presented within the report commentary for the number of 18-20 year olds with Enhanced (initial) Incentives status was rounded incorrectly and has also been updated.

  3. The data shown in Table 2.1 were found to be inaccurate due to a duplicate record which has now been removed and figures revised. Additionally, in response to new guidance on statistical disclosure, Table 2.1 has been updated to release greater detail about the historic transgender prisoner population.
