Yorkshire Water Services Limited (YW) has applied to the Environment Agency for three licences.

The Environment Agency is giving notice of this application in accordance with Section 37 of the Water Resources Act 1991 and Regulation 6 of the Water Resources (Abstraction and Impounding) Regulations 2006.

Two applications are for impoundment licences to allow YW to vary the release of water (compensation flow) from their Brownhill Reservoir at National Grid Reference (NGR) SE 11 06, and Digley Reservoir at NGR SE 11 06 following flow trials carried out by YW since April 2004. The purpose of the flow trials was to secure appropriate flow regimes for the River Holme and Digley Brook as a result of Water Framework Directive requirements.

One application is to vary abstraction licence serial number 2/27/10/011 which authorises the abstraction of water from Brownhill Reservoir at NGR SE 11 06. The variation is to remove the reference to the compensation releases as set out in the Act of Parliament.

The construction and compensation flow from Brownhill Reservoir is currently specified in the Batley Corporation Act 1921 (“1921 Act”). YW have applied to revoke sections 5 (Work No.1), 14, 15 and 16 (parts (3), (4), (5) only) of the 1921 Act. The construction and compensation flow from Digley Reservoir is currently specified in the Huddersfield Corporation Act 1937 (“1937 Act”). YW have applied to revoke sections 24(1) (Work No.1) and 38 of the 1937 Act. Sections 42 and 43 of the 1937 Act will also be revoked in so far as they relate to Digley Reservoir (these sections will remain valid for Holme Styes Reservoir). The details currently controlled in those sections of the 1921 and 1937 Acts relating to Brownhill and Digley Reservoirs are either no longer considered to be required or would be controlled by the two impoundment licences.

Brownhill Reservoir The 1921 Act sets the compensation requirement as a quantity of water not less than 1,166,000 gallons (5,301 cubic metres (m3)) on each working day as defined in the said section other than Saturdays and of not less than 680,000 gallons (3,091m3) on each Saturday. No releases are required on a Sunday.

Digley Reservoir The 1937 Act sets the compensation requirement as (a) a quantity of water of not less than 138,226 gallons (628m3) during each working hour; and (b) a quantity of water of not less than 8,383 gallons (38m3) during each non-working hour.’

YW are proposing to vary the compensation flows from the two reservoirs as follows:

Brownhill Reservoir To release 6,900 cubic metres of water per day (m3/d) from the reservoir during January, February, March, November and December; 5,400 m3/d during April, May, August, September and October; and 4,800 m3/d during June and July in each year.

Digley Reservoir To release 10,600 m3/d of water from the reservoir during January, November and December; 5,800 m3/d during February, March, April, May, August, September and October; 4,500 m3/d during June; and 3,200 m3/d during July in each year.
