Justification of quantities
The applicant has not been able to demonstrate continued justification to enable renewal of the licence. There has been no abstraction since the licence was first granted and insufficient progress in gaining planning permission for the proposed reservoir.
In addition, the necessary derogation agreement has not been agreed between the licence holder and the owner of a nearby borehole which has been judged likely to be impacted by the proposed trade between this licence and another held by Mr Young.
Resource assessment:
A pump test took place at Mere Farm to assess the suitability of a trade, this showed a likely impact on a nearby private borehole. The applicant has been seeking a derogation agreement with the owner of the private borehole, which is necessary (under sections 39 and 51 of the Water Resources Act 1991) to enable us to vary licence AN/034/0006/029. To date this agreement has not been made. The applicant was informed, when the licence was originally granted, that the licence would not be renewed if this agreement was not secured.
Conclusion and recommendation:
There has been no abstraction since the licence was first granted and no progress has been made towards gaining planning permission for the proposed reservoir.
The abstraction cannot take place unless a derogation agreement is in place. The necessary derogation agreement is not in place.
