1. VAT28.1 Witnesses attending trials in the UK

ECOs may receive applications from key witnesses / defendants to attend a trial in the UK. If the applicant does not meet the visitor requirements of the Rules but provides confirmation from solicitors / police / CPS that attendance in person at the trial is essential to either the prosecution or the defence and that alternatives such as a sworn affidavit or videolink are not appropriate, ECOs should refer full details of the case to RCU as soon as possible.

ECOs should complete the RCU pro forma including a full summary (attaching any relevant supporting documents) outlining why the applicant’s presence at the trial is considered essential and relevant trial dates. RCU will consider a grant of leave outside the Immigration Rules.
