Use mobile plant for landspreading in England or Wales: RPS 203

There are new rules from January 2017 for these standard rules permits:
- SR2010 No4: mobile plant for landspreading
- SR2010 No5: mobile plant for reclamation, restoration or improvement of land
- SR2010 No6: mobile plant for landspreading of sewage sludge
The amendments only apply to English standard rules permits. So the Welsh equivalent standard rules permits now contain different conditions to the English ones.
If you comply with this regulatory position statement (RPS):
- Welsh standard rules permit holders can still apply to use mobile plant for landspreading activities in England
- English standard rules permit holders can still apply to use mobile plant for landspreading activities in Wales
1. Conditions you must comply with
You must follow certain conditions depending on if you’re in England or Wales.
1.1 Use mobile plant in England using Welsh rules
If you want to use mobile plant in England using the Welsh standard rules SR2010 No4, SR2010 No5 and SR2010 No6, you must:
- complete the Environment Agency’s mobile plant deployment form
- send your application to the Environment Agency with the supporting documentation and pay the correct fee
- make sure the activities detailed in your deployment form comply with the equivalent English version of the standard rule
If you meet these criteria the Environment Agency will assess your application in the same way as applications from holders of English standard rules permits.
1.2 Use mobile plant in Wales using English rules
If you want to use mobile plant for landspreading in Wales under an equivalent English standard rules permit, you must:
- complete the Natural Resources Wales (NRW) mobile plant deployment form
- send your application to NRW with the supporting documentation and pay the correct fee
NRW will assess your application against their existing sets of standard rules until they have finished their consultation and published any new rules.
You must make sure the way you operate doesn’t endanger human health or the environment. You must not:
- cause a risk to water, air, soil, plants or animals
- cause a nuisance through noise or odours
- adversely affect the countryside or places of special interest
2. Enforcement
An RPS means that the Environment Agency will not normally take enforcement action against you provided:
- your activity meets the description set out in this RPS
- you comply with the conditions set out in this RPS
- your activity doesn’t (and isn’t likely) to cause environmental pollution or harm human health
3. When to check back
This RPS will be reviewed by 31 December 2017. You’ll need to check back then to see if it still applies.
