On 5 September 2022, Poole Harbour Commissioners (“the applicant”) made a formal application to the Marine Management Organisation (“MMO”) under Section 14 of the Harbours Act 1964 for a Harbour Revision Order (“HRO”).

Details

If made, the proposed order would modernise and consolidate the statutory harbour powers applying in relation to Poole Harbour. The proposed order provides for the updated constitution of the Commissioners; the establishment of an advisory body or bodies consisting of harbour stakeholders with which the applicant is required to consult on material matters; modernised powers of management and control of the Harbour to vest in the applicant including provisions relating to powers of general direction and navigational safety and clarification of the extent of the premises of the Harbour; powers relating to commercial activities, conservation, bunkering, aids to navigation, dredging, the repair of landing places etc, and provisions relating to the control and licensing of works and dredging.

To facilitate the above, article 38 of the proposed order revokes the Acts and Orders set out in Schedule 3 to the proposed order and amends the Acts and Orders set out in articles 36 and 37 of the proposed order.

The order also sets out the penalty for offences for failure to comply with directions. More information about the proposals can be viewed in the statement in support and the draft HRO. The statutory 42-day public consultation on the HRO starts on 9 August 2023 and ends on 19 September 2023. An objection or representation should:

  • Be received before the expiry of a period of 42-days consultation period
  • Be made in writing and quoting reference HRO/2022/00002
  • State the grounds of the objection or representation
  • Indicate who is making the objection or representation; and
  • Give an address to which correspondence relating to the objection or representation may be sent
