Details

The purpose of this divisional circular letter is to bring to attention to all building control bodies (BCBs) and other interested parties The Building (Amendment) Regulations 2012 (SI 2012/718).

The Regulations were made on 7 March 2012 and came into force on 6 April 2012.

Application to Wales

The power to make building regulations which apply to Wales was transferred to Welsh Ministers (with one relevant exception) as from 31 December 2011. The one exception applicable to this instrument is that the Secretary of State still has the power to make building regulations for excepted energy buildings in Wales. This is explained more fully in Circular 01/2012.

The changes made by SI 2012/718 thus apply only in England and to excepted energy buildings in Wales. It will be for Welsh Ministers to decide whether to make similar changes applying to Wales other than to excepted energy buildings.

Competent person schemes

The amendments in SI 2012/718 make a number of changes to the list of competent person schemes in Schedule 3 to the Building Regulations 2010. These are more fully set out in the Amendment Regulations and in Circular 01/2012.
