Standard rules permits for anaerobic digestion – point source emissions to air: RPS 192

This regulatory position statement (RPS) applies if your anaerobic digestion standard rules permit does not specify point source emissions to air. It applies until we vary or withdraw the standard rules.
If you follow the conditions in this RPS, we will allow additional point source emissions from:
- biofilters and scrubbing systems
- biogas upgrading plant
- digestate drying plant – but only if you reduce emissions through biofilters and scrubbing systems
Conditions you must comply with
You must:
- follow the manufacturer’s instructions when you operate the biofilters, scrubbing systems, biogas upgrading plant and digestate drying plant
- maintain the equipment so it is effective at minimising emissions
- include details of the design and maintenance of the plant and associated biofilters, scrubbing systems, biogas upgrading plant and digestate drying plant in your management system and odour management plan
- keep records for 1 year that show you have complied with this RPS – you must make these records available to the Environment Agency on request
All other conditions of your standard rules permit still apply.
You must make sure your activities do not endanger human health or the environment. You must not:
- cause a risk to water, air, soil, plants or animals
- cause a nuisance through noise or odours
- adversely affect the countryside or places of special interest
This RPS does not apply to any other activity, even if it is under the same legislation. You may still need other permits or licences for other activities you carry out.
Enforcement
An RPS means that the Environment Agency will not normally take enforcement action against you for operating without a permit for a waste operation provided:
- your activity meets the description set out in this RPS
- you comply with the conditions set out in this RPS
- your activity does not, and is not likely to, cause environmental pollution or harm human health
When to check back
This RPS will expire when we publish the revised anaerobic digestion standard rules – we expect to do this by the end of 2020.
