Responsible Actors Scheme: prohibitions list

The Responsible Actors Scheme: Prohibitions list is published in accordance with Regulation 20 (1) (b) of the Building Safety (Responsible Actors Scheme and Prohibitions) Regulations 2023.

This list will be maintained and kept up to date.

Under the Regulations the Secretary of State must prepare, maintain and publish a list of persons to whom Regulation 28 (Application of Prohibitions) applies.

An eligible developer who is invited to join the Responsible Actors Scheme, but does not sign up to the Scheme, or who joins but then has their membership revoked because they fail to comply with the Scheme’s membership conditions, will be given notice that their name will be added to this list along with the names of any entities they control.

Once a person has been notified and added to this list, the named person will be prohibited from carrying out major development and from securing building control approval in accordance with the regulations.

The regulations provide for limited exceptions to the prohibitions in order to protect certain innocent third parties from the prohibitions. Part 3 of the Regulations provides an opportunity for persons to apply for an exception. There are currently no persons to whom prohibitions apply under the Building Safety (Responsible Actors Scheme and Prohibitions) Regulations 2023.
