1. Request under the Freedom of Information Act 2000

Thank you for your email, received on 25 May 2022, in which you requested information from the office of the Pubs Code Adjudicator (PCA) under the Freedom of Information Act 2000 (the FOI Act).  

The FOI Act entitles you to: 

  • know whether the information you have requested is held by the PCA; and 

  • be provided with that information, subject to any exemptions in the FOI Act which may apply. 

On 25 May 2022 you made the following request for information held by the PCA:

  1. How many of your staff have been accused of a) sexual misconduct, or b) other professional misconduct in the workplace since 1st January 2021?

  2. How many of your staff have been disciplined for a) sexual misconduct, or b) other professional misconduct in the workplace since 1st January 2021?

I can confirm that the PCA Office does not hold the information requested.

Please note that the PCA Office cannot employ any staff direct. Under paragraph 9 of Schedule 1 to the Small Business, Enterprise and Employment Act 2015 the PCA may make arrangements for persons to be seconded to the PCA Office to serve as staff. The PCA Office therefore does not have any employees. PCA Office staff are employed by, and have been seconded from, government departments or external private sector organisations, or may be agency workers.

As the PCA is not the employer of PCA Office staff it would not necessarily be aware of accusations that could have been made to a secondee’s employer or about whether secondees may have been subject to disciplinary action by their employer as a result of any misconduct since 1 January 2021.

If you do not believe that the office of the PCA has provided an appropriate response to your request, you are entitled to ask for an internal review. Internal review requests should be submitted within two months of the date of receipt of the response to your original request and should be made in writing, quoting the above reference,
