Privacy Notices for Content Involving Members of the Public

This notice sets out how we will use your personal data, and your rights. It is made under Articles 13 and/or 14 of the UK General Data Protection Regulation (UK GDPR). 

Your data

Purpose

The purpose for which we are processing your personal data is to produce content for government messaging to raise awareness of government policy, initiatives or issues of public concern. To do that we would like to include members of the public with relevant experiences to highlight particular issues or raise awareness of government action or priorities. 

With your agreement we would like to use your personal data in advertising that will be shared on social media channels, and may be seen by many people.  With your consent, we may also use your image in government advertising that appears on TV and in print.

We will also retain your contact details and share these with our agencies so they can arrange with you to participate in the publicity

The data

We will process the following personal data: your image, video recording, audio recording, name, social media name/identifier, location, age, email address, telephone and your relationship to the issue being promoted.

We may also cover more sensitive topics that will refer to your health or other sensitive matters. We will only do this with your positive agreement. 

The legal basis for processing your personal data is because you consent to us doing so (Article 6(1)(a) UK GDPR). 

Sensitive personal data is personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, and the processing of genetic data, biometric data for the purpose of uniquely identifying a natural person, data concerning health or data concerning a natural person’s sex life or sexual orientation. 

The legal basis for processing your sensitive personal data is that you have given your explicit consent (Article 9(2)(a) UK GDPR). 

Recipients

Your personal data will be shared by us with advertising agencies, social media companies and websites and it will be seen by members of the pubic in the UK and abroad. 

As your personal data will be stored on our IT infrastructure it will also be shared with our data processors who provide email, and document management and storage services. 

Retention 

Your personal data will be kept by us for two years, unless you withdraw your consent sooner. 

Your rights

You have the right to withdraw consent to the processing of your personal data at any time. We will remove the data from channels we control, but data published on the internet may be copied and reshared in ways that we cannot control. 

You have the right to request information about how your personal data are processed, and to request a copy of that personal data. 

You have the right to request that any inaccuracies in your personal data are rectified without delay. 

You have the right to request that any incomplete personal data are completed, including by means of a supplementary statement. 

You have the right to request that your personal data are erased if there is no longer a justification for them to be processed. 

You have the right in certain circumstances (for example, where accuracy is contested) to request that the processing of your personal data is restricted. 

You have the right to request a copy of any personal data you have provided, and for this to be provided in a structured, commonly used and machine-readable format.

International transfers

As your personal data is stored on our IT infrastructure, and shared with our data processors, it may be transferred and stored securely outside the UK. Where that is the case it will be subject to equivalent legal protection through an adequacy decision, reliance on Standard Contractual Clauses or a UK International Data Transfer Agreement.

Because data published on the internet and social media can be seen from anywhere, your data will be accessed from outside the UK. Where this is the case we rely on your explicit consent under Article 49(1)(a) UK GDPR. 

Complaints

If you consider that your personal data has been misused or mishandled, you may make a complaint to the Information Commissioner, who is an independent regulator.  The Information Commissioner can be contacted at:

Any complaint to the Information Commissioner is without prejudice to your right to seek redress through the courts.
