  1. Updated the ‘Using your data to fund your learning, school or childcare’ section to include funding to schools for specific programmes, including free breakfast clubs, the Music and Dance Scheme, free school meals and holiday activities and food programme clubs.

  2. Updated sections 9, 10, 11, 13, 14, 15, 16, and 18 to link to relevant sections in the Members of the public privacy notice. The list of approved trialling agencies has changed.

  3. Added new sections, 'Using your data to gather evidence for policy development and delivery' and 'Using your data when you attend our events or webinars'. The 'Using your data to monitor attendance in education and learning' section has been merged with the section on 'Using your data to record, monitor and report on your learning achievements or attainments and attendance'. Added details about longitudinal research studies to the 'Using your data so we can undertake long-term research and publish official statistics'

  4. Updated the 'How long we keep your data’ sections and added a link to the DfE retention schedule.

  5. Reformatted the document to make it easier to read.

  6. Updated how your data is used to carry out research and added a section on using your data for the Risk Protection Arrangement.

  7. Updated section on 'Using your data to support your learning'. Added section 'Using your data when we share your personal information'.

  8. Updated the description and data collected details in the sections about learning achievements or attainments and validation trials.

  9. Added details about the retention of deeds. Updated the retention details for LEO, PPMD and NPD in these sections: reporting on achievements, improving education of children, monitoring attendance and long-term research. Added links to sections on looked-after children, children in need and serious incident notification. Updated the details on data collected in the sections on complaints and enquiries and lawful basis in long-term research.

This document details what personal data we process about learners in the following:

  • early years foundation stage (EYFS), which covers nursery and reception years – learners are 3 to 5 years old
  • key stage 1 (KS1) – learners are 5 to 7 years old in years 1 to 2
  • key stage 2 (KS2) – learners are 7 to 11 years old in years 3 to 6
  • key stage 3 (KS3) – learners are 11 to 14 years old in years 7 to 9

This includes learners in schools, academies and independent schools, as well as learners in hospital schools or alternative provision, or who are home educated.
