Operation of the ‘Customs Tool’ to the Continental Shelf and Exclusive Economic Zone (Anti-Dumping Duty 2367)

Published 31 October 2019

Operation of the ‘Customs Tool’ extending anti-dumping and countervailing duties to the Continental Shelf and Exclusive Economic Zone, when explicitly provided for by the regulation imposing those duties.

The Commission announced in the Official Journal ref. 2019/C366 dated 30 October 2019, that the ‘Customs Tool’ adopted by Regulation 2019/1131 OJ ref. L179, on 3 July 2019 is coming into operation.

This takes effect from 4 November 2019.

This means that, in future, where an anti-dumping or countervailing duty regulation, explicitly extends the duties to an artificial island, a fixed or floating installation or any other structure in the Continental Shelf or the Exclusive Economic Zone, whether sent directly from third countries or indirectly, those products will be liable to the duties.

Procedures relating to the notification and declaration of such products can be found in regulation 2019/1131.
