Notice to Traders 69/24 - Quotas for Cheeses for Export to Designated Importers in the United States of America (USA)

Introduction

This notice informs you of the application process, requirements, and quantities available for the export of various cheeses to the USA for 2025.

Quantities Available

The quantities available for export for 2025 are:

  • 73,170 kgs from the Tokyo Round
  • 996,831 kgs from the Uruguay Round

The cheese must be of UK origin. There are requirements in the USA relating to origin for these quotas.

You must apply to RPA for an export licence if you want to use these quotas.

The products included and the quantities available are listed in Annex 1 to this notice.

Some product groups shown in column 2 of Annex 1 are divided between the Uruguay Round (UR) quota and the Tokyo Round (TR) quota. You must apply for each quota separately.

Applications

You must be established, and registered for VAT, in the UK in order to apply for licences.

Your application(s) must be for a minimum of 10,000 kgs (except for Blue Mould) but not exceed 40% of the total quantity available for each product group (see columns 4 and 5 of Annex 1).

You must state the following in box 20 of your application(s):

“For export to the United States of America: Quota for 2025”

“Quota Identification: (as stated in Annex 1)” ………..……………”

Your application(s) must be submitted to RPA between 1 - 10 September 2024, and must be received by 5pm on 10 September 2024.  It is your responsibility to ensure that your application and all supporting documentation are correct at the time of submission.

No security is required with your application(s).

Additional Information

You must also provide with your application(s):

  • the product group in accordance with additional notes 16-23 and 25 of Chapter 4 of the Harmonised Tariff Schedule of the United States
  • the product name in accordance with the Harmonised Tariff Schedule of the United States
  • the name and address of the designated importer in the USA. To be eligible under these arrangements the importer must be a subsidiary of your company

Additional Documentation

Your application(s) must be accompanied by:

  • a declaration from the designated importer that they are eligible under the rules in force in the USA on the issue of import licences for the products concerned
  • evidence that you have exported cheese to the USA in at least one of the last three calendar years. The cheese must have been exported from the UK

Allocations

If the total quantities applied for exceed the quantities available for a particular group an allocation coefficient will be applied to the applications for that group.

If the total quantities applied for do not exceed the quantities available for a particular group we may offer the remaining quantities to applicants in proportion to the quantities applied for.

We will inform you of your allocations by 31 October 2024. Licences will be issued by 15 December 2024 and will be valid from 1 January until 31 December 2025.

Transfer of Rights

You cannot transfer the rights on your licence.

Licence Obligations

Your licence will carry an obligation to export to the USA.
