NTE 2025/29: the Export Control (Amendment) (No.2) Regulations 2025

Introduction

This is an advance notice of the upcoming Statutory Instrument (SI): The Export Control (Amendment) (No.2) Regulations 2025 (‘the regulations’). It is intended to lay the regulations in November and come into force in December. The regulations will introduce a series of legislative updates to the UK’s export control framework.

The regulations and explanatory memorandum to the Regulations will be published on legislation.gov.uk in due course.

Upcoming updates to UK strategic export controls

The regulations intend to update the UK’s export control framework to align with international commitments and recent EU regulatory changes. The amendments are expected to address controls on emerging technologies, dual-use goods, and items related to torture and capital punishment, while also reflecting changes in UK policy towards Armenia and Azerbaijan.

The 2025 Regulations will amend and update controls on specific emerging technologies as part of the UK’s international commitment to strengthen export controls for national security purposes.

In particular, and further to adoption by the EU of similar controls which apply in Northern Ireland, the amends effectively ‘move’ controls on these goods and technology from Schedule 3 of The Export Control Order 2008 (S.I. 2008/3231) (the ‘2008 Order’) to Annex I of the assimilated Dual Use Regulation Council Regulation (EC) No 428/2009, and update the list of those controlled items.

This ensures alignment with the EU while avoiding duplication of controls in Northern Ireland, where the corresponding EU regulations apply directly.

The regulations will also:

  • update Schedule 4 of the 2008 Order to reflect the lifting of the arms embargo on Armenia and Azerbaijan, while providing certain goods remain subject to transit control
  • revise specific control entries to ensure consistency with international regimes
  • amend Annex II and III of the assimilated Torture Goods Regulation to update controls on trade in goods that could be used for capital punishment, torture and other cruel, inhuman, or degrading treatment or punishment. This is intended to bring the controlled items into alignment with the corresponding EU regulation – Regulation (EU) 2019/125 of the European Parliament and of the Council of 16 January 2019
