NOTICE TO TRADERS 06/20 - IMPORT TARIFF QUOTA FOR POULTRYMEAT FROM UKRAINE

Introduction

The quantities available to import under the next sub-period for the Import Tariff Quota for 2020 are detailed in Annex 1 attached.

The quota will be open from 1 January until 31 December 2020 and be divided into four sub-periods as follows:

  • 25% from 1 January to 31 March;

  • 25% from 1 April to 30 June;

  • 25% from 1 July to 30 September; and

  • 25% from 1 October to 31 December.

The quota will be managed using rights applications and licence applications.

Import Rights applications

For the sub-period 1 April 2020 to 30 June 2020, you may apply for import rights between 1 March 2020 and 12 noon on 6 March 2020.

Your application must not exceed 25% of your reference quantity (see Proof of Trade below) and must be supported by a security €35 per 100kgs.

Import rights will be valid until 31 December 2020 and are not transferable.

Proof of trade

If it is your first application of the quota year, you must provide evidence to show that you imported or exported poultry products during:

  • the 12-month period immediately prior to the time of your application; and

  • the 12-month period immediately prior to that.

For your first application of the quota year you must provide evidence to show that you have imported poultry products falling under CN codes 0207, 0210 9939, 1602 31, 1602 32 or 1602 3921 during the 12-month period ending one month before the time of your application. This will be your reference quantity.

You must supply the original import document (C88) form or a copy certified as a ‘true copy’ of the original stamped by Customs. We will not accept photocopies of the Customs stamp or scanned versions of these documents.

We do not need endorsed C88 documents for electronic licence attributions.

Licence applications

Your application can only be submitted in the Member State where you have obtained import rights. Your application cannot exceed the quantity for which you have been awarded import rights.

In box 8, the country of origin, you must indicate ‘Ukraine’ and put a cross in the ‘Yes’ box. This means your licence will only be valid to import from Ukraine.

In box 20, special particulars, you must state ‘Implementing Regulation (EU) No 2078/2015.’

Your application must be supported by a security of €75 per 100kgs.

Licence / rights securities

In box 11 (for licences) or part C (for rights) you should state:

  • the amount of security expressed in the same unit of currency that your guarantee is lodged;

  • the type of security, for example ‘block guarantee’, ‘cash’ or ‘single transaction guarantee’; and

  • the trader number of the block guarantee holder if you are using another trader’s block guarantee.

If you are using another trader’s block guarantee you must make sure that your cross-reference details are set up before you send us your application.

Note: We will reject your application if the cross-reference is not set up and you do not submit security in another format within the application period.

Note: We will not accept any amendments to block guarantees after the application period has closed. This includes cross-reference amendments.

Licence validity period

Your licence will be valid for 30 days. However, licences will not be valid beyond 31 December 2020.

Release of security

You must return your paper licences within 45 days of the expiry date or you will forfeit your security.

Security against the main electronic licence (excluding extracts) will be released automatically upon attribution of at least 95% of the licence quantity.

Your import rights security will be released proportionately when licences are applied for.
