New and retreaded tyres for buses and lorries, originating in China (Anti-Dumping Duty 2301)

Imposing definitive Anti-Dumping Duty (ADD) on imports of certain new and retreaded tyres for buses or lorries, originating in the People’s Republic of China.
The Commission, by Regulation (EU) No 2018/1579 OJ L263, has imposed definitive Anti-Dumping Duty on imports of pneumatic tyres originating in the People’s Republic of China.
These are:
- new or retreaded
- of rubber
- of a kind used for buses or lorries
- with a load index exceeding 121
This regulation takes effect from 23 October 2018.
The products are classified within the following commodity codes:
• 4011 2090 00
• 4012 1200 10
The definitive ADD on the product will be as follows:

The application of the individual duty rates for the companies listed is conditional upon the presentation to customs authorities of a valid commercial invoice, which contains the following declaration:
‘I the undersigned, certify that the (volume) of (product concerned) sold for export to the European Union covered by this invoice was manufactured by (company name and address) (TARIC additional code) in the People’s Republic of China. I declare that the information provided in this invoice is complete and correct.’
This declaration must be dated and signed by an official of the entity issuing the invoice, identified by their name and function.
If no such invoice is presented, the duties applicable to ‘all other companies’ will apply.
Road, trailer and semi-trailer wheels fitted with pneumatic tyres that meet the above description will be classified under TARIC codes:
- 8708 7010 15
- 8708 7010 80
- 8708 7050 15
- 8708 7050 80
- 8708 7091 15
- 8708 7099 15
- 8716 9090 15
- 8716 9090 80
New exporters may apply to the Commission to be subject to the duty rate of 49.31 euros per item, subject to meeting conditions – see the regulation for details.
Provisional duty will be definitively collected. Amounts secured in excess of the definitive anti-dumping rates may be reclaimed, details below.
CHIEF was updated at 13:20 on 23 October 2018. Post clearance action may be necessary. The printed tariff will be updated in the 2019 edition.

Repayment of secured provisional ADD
Traders including Customs Freight Simplified Procedures (CFSP) who are entitled to repayments of secured ADD in excess of the definitive rates are now required to submit claims to the National Import Duty Adjustment Centre (NIDAC).

Claims must include a copy of the original import declaration and commercial documents such as invoices and transport documents. Where traders have claimed a company specific rate of duty, they must provide documentation to support this claim.

Security will be held for 4 months from the Definitive ruling date. After this time claims will need to be submitted to the National Duty Repayment Centre using form C285 in order to process the refund.
