Joint conditional order process for applicant 2 – litigant in person

Updated 10 April 2024

Applies to England and Wales

This details the process for an unrepresented second applicant (applicant 2) in a joint application. It is intended to help applicant 1’s solicitors to guide applicant 2 through the process.

1. Starting the application

1. Applicant 2 will receive an email to say that the conditional order has been applied for by applicant 1 and that they now need to apply.

2. Once they have logged in, they will see their homepage and a message to say they can apply for a conditional order.

3. After selecting ‘Apply for a conditional order’, they will be asked if they want to continue with the joint divorce application.

4. If they select ‘I do not want to continue with my divorce application’, they will be shown instructions on withdrawing from the joint application. This will include information about continuing as a sole applicant.

2. Reviewing the application

1. If they select ‘I want to continue with my divorce application’, they will be shown the application to review.

2. They will be asked to confirm that the application is still correct. If they select ‘No’ they will get the option to change their contact details or any other information.

3. Submitting the application

1. If they select ‘Yes’ that the information is still correct, or once they have added corrections, they will select ‘Continue’. They will then be shown their answers to check. They get another opportunity here to change their answers. They will then check the statement of truth box and select ‘Continue’.

2. Their homepage will be updated to say that both parties have applied for a conditional order and explain the next steps.

Both applicants will be sent an email to say the application is submitted and explaining what happens next.

The case will go to the legal advisor for review.
