Working with the Mining Remediation Authority on significant infrastructure projects in coalfield areas in Wales

The Infrastructure (Wales) Act 2024 sets out the consent process for major infrastructure projects in the fields of energy, transport, water, wastewater and waste.
These are known as significant infrastructure projects (SIP) and examples include:
- large scale wind, solar and other energy generating stations
- overhead electric lines
- major highway schemes
- liquid natural gas facilities
- hazardous waste facilities
- railways or rail freight interchanges
The Coal Authority, trading as the Mining Remediation Authority, is a statutory consultee in the planning process.
Statutory consultees are bodies that must be notified and consulted in relation to SIP applications and play an important role in ensuring that their areas of expertise are reflected within development proposals.
1. Statutory consultee cost recovery
In December 2025 we, in our role of statutory consultee in the planning process, were granted powers under the Infrastructure Consent (Fees) (Wales) Regulations 2025 to recover costs incurred in providing some services to promoters of projects brought forward under the SIP regime.
We are commencing recovery of costs from 1 July 2026. Our cost recovery will relate to projects at the acceptance through to examination stage.
2. Our fees
Our fees will be based on cost recovery rates only. This will be based on our charge out rates at the time of the work being undertaken.
You will be given an estimation of our costs and how they have been calculated in a draft quotation. If the final cost is likely to be significantly different from the estimated cost, you will be notified and given an explanation with an updated quote.
Once the work has been completed, we will provide a final invoice for the exact amount payable, with a specified period in which to pay.

The Mining Remediation Authority is the trading name of the Coal Authority, established pursuant to Section 1 of the Coal Industry Act 1994, of 200 Lichfield Lane, Berry Hill, Mansfield, Nottinghamshire, NG18 4RG. The Coal Authority remains the legal name of the authority.
