Spreading waste silt from watercress bed settlement ponds: LRWP 28

This low risk waste position (LRWP) applies to spreading waste silt (European Waste Catalogue Code 17 05 06) from de-silting watercress bed settlement ponds.

If you follow the conditions in this LRWP you can carry out the activity without an environmental permit for a waste operation.

Conditions you must comply with

You must:

  • store the waste silt in a secure place
  • only store up to 1,250 tonnes of waste silt at any one time
  • only store waste silt for up to 12 months before spreading
  • only spread waste silt on agricultural or non-agricultural land to benefit the land
  • only spread waste silt on land adjacent to where it is dredged
  • limit the spreading application rate to 150 tonnes per hectare over any 12 month period

You must make sure your activities do not endanger human health or the environment. You must not:

  • cause a risk to water, air, soil, plants or animals
  • cause a nuisance through noise or odours
  • adversely affect the countryside or places of special interest

Enforcement

A LRWP means that the Environment Agency will not normally take enforcement action against you provided:

  • your activity meets the description set out in this LRWP
  • you comply with the conditions set out in this LRWP
  • your activity does not, and is not likely to, cause environmental pollution or harm human health
