Following the opening of a statutory inquiry into Legal Action, the Charity Commission appointed interim managers to the charity to the exclusion of its trustees, by way of an order made pursuant to section 76(3)(g) of the Charities Act 2011.

The commission was asked by a trustee of Legal Action to review its decision to appoint the interim managers on a number of different grounds. The decision was reviewed at board level by 3 reviewers who also considered further submissions by the trustee. The issues for the reviewers were: 1) whether the decision was lawfully and otherwise properly made, and 2) whether the decision should, at the date of the review, be discharged, remain in place or varied.

The reviewers concluded that there is evidence of misconduct/mismanagement in the administration of Legal Action per the requirement in section 76 and therefore, the decision was lawfully and properly made. The reviewers also concluded that the order appointing the interim managers is to remain in place.
