Privacy notice relating to data collection for land based measures.

1. Purpose for Processing

Land Based Measures consists of 5 services:

1.1 Basic Payment Scheme (BPS)

A land-based support measure. Initially funded by the European Union to help the farming industry, within the framework of the Common Agricultural Policy, it is now funded by the United Kingdom (UK).

1.2 Delinked Payments

Existing BPS data that is currently stored in Rural Payments Service (RPS) will be collected to calculate delinked reference data.

1.3 Lump Sum Exit Scheme

A service offering farmers who wish to exit the industry the option of taking a lump sum payment in place of any further direct payments.

1.4 Payments Entitlement Register for Applications of BPS

A system for identification of payment entitlements in European Union Member States applying the BPS.

1.5 Cross-compliance

A set of rules which farmers and land managers must follow on their holding if they are claiming rural payments under RPA services.

2. Why we are able to process your personal data

The law allows us to process your personal data under article 6(1)(e) of the UK General Data Protection Regulation (UK GDPR). We are allowed to process personal data when we need to carry out a public task.

For delinked payments specifically, Defra are exercising their functions delivering government policy under the powers of S.1(1) of the Agriculture Act.

We have a legal obligation to provide beneficiary data to Defra, who publish it to meet EU retained legislation, aimed at promoting transparency.

3. What personal data we process

The information we collect and process is:

  • customer registration information
  • bank account information
  • Single Business Identifier (SBI) or county parish holding (CPH) numbers
  • details of entitlements, payments (including delinked payments)
  • reductions and penalties
  • information statements generated from reference data
  • details of anyone who acts for you, for example an agent

We may process your personal data including your email address in any questions or feedback you send to us. We may also use your information to contact you about future grants and updates to farming policy that would be relevant to you.

4. Your responsibility with other people’s personal data

If you’ve included personal data about other people in your records, you must tell them. You must provide them with a copy of this privacy notice so that they know how their personal data will be used.

5. Where your personal data is stored

We store, transfer and process your personal data on our servers in the United Kingdom (UK) and the European Union (EU).

6. How long we keep your personal data

For the following services we keep your information for 11 years:

  • Payments Entitlement Register for Applicants of BPS
  • Basic Payment Scheme

For the following services we keep your information for 7 years:

  • delinked payments
  • cross-compliance

For the Lump Sum Exit Scheme we keep your information for:

  • at least 3 years for Expressions of Interest
  • at least 7 years from the end of the agreement for those accepted onto the scheme
